Deployment Playbook — Terms of Service
Version: 29 October 2026 — effective 29 October 2026
1. Parties and scope
1.1 These Terms apply to every agreement between Generation Y B.V., registered with the Dutch Chamber of Commerce (KvK) under number 83458034, with its registered office at Planciusplein 13A, 4812 SE Breda, the Netherlands, VAT number NL862881833B01 ("Provider", "we") and the business customer that creates a workspace or subscribes to Deployment Playbook ("Customer"). 1.2 The Service is offered exclusively to businesses and professionals acting in the course of their trade or profession. Consumers (consumenten) may not use the Service. By accepting, the person accepting confirms they are authorised to bind the Customer. 1.3 General terms of the Customer are expressly rejected.
2. The Service
2.1 Deployment Playbook is a web-based application for documenting deployment playbooks, running deployments with approvals (including four-eyes approvals) and keeping audit logs ("Service"). 2.2 We may change and improve the Service. We will not materially reduce core functionality of a paid plan during a paid period without notice of at least 30 days.
3. Accounts and workspaces
3.1 Subscriptions are per workspace. The Customer is responsible for its users, their credentials and API tokens, and all activity in its workspace. 3.2 The Customer notifies us without delay at info@genydev.nl of any suspected unauthorised access.
4. Trial
4.1 A new workspace may receive a free trial of a paid plan for 14 days. No payment card is required for the trial and nothing is charged. 4.2 At the end of the trial the workspace automatically moves to the Free plan, with its limits. Nothing is charged unless the Customer subscribes to a paid plan.
4A. Free plan and Early access workspaces
4A.1 The Free plan is free of charge and has the limits shown on the pricing page (for example a maximum number of members, active plans and templates). 4A.2 Workspaces created before paid plans were introduced have an "Early access" plan. If an Early access workspace cancels, it moves to the Free plan and keeps its data. If its usage then exceeds the Free plan limits, the workspace becomes read-only until the Customer upgrades or reduces its usage to within the limits.
5. Plans, prices and payment
5.1 Paid plans (currently Team and Business) are billed in euros (EUR), monthly or yearly in advance, via our payment processor Stripe. Prices are as shown on the pricing page or in checkout at the time of ordering and are exclusive of VAT unless stated otherwise. VAT is charged where applicable (including reverse-charge for EU B2B customers with a valid VAT number). 5.2 By subscribing, the Customer authorises recurring charges to the payment method provided. 5.3 If payment fails, we may, after a reminder, limit or suspend paid features until payment is received. Statutory commercial interest (wettelijke handelsrente, art. 6:119a Dutch Civil Code) may apply to overdue amounts. 5.4 We may change prices with at least 30 days' notice; changes take effect from the next renewal period.
6. Term, renewal and cancellation
6.1 Subscriptions renew automatically for the same period (month or year) unless cancelled. 6.2 The Customer may cancel at any time, self-service via the Stripe customer portal (reachable from the workspace billing page) or by email to info@genydev.nl; cancellation takes effect at the end of the current paid period. Access to paid features continues until then, after which the workspace moves to the Free plan. 6.2A Upgrades take effect immediately and are charged pro rata for the remainder of the current period. Downgrades take effect at the start of the next billing period. 6.3 Fees paid are non-refundable, including for partial periods, downgrades or unused time, except where mandatory law requires otherwise or as stated in our Cancellation & Refund Policy. 6.4 We may terminate or suspend with immediate effect if the Customer materially breaches these Terms (including non-payment or unlawful use), becomes insolvent, or if required by law. We may otherwise terminate with 90 days' notice, refunding prepaid fees for the unused period.
7. Acceptable use
The Customer will not: use the Service unlawfully; upload malware; attempt to breach security or access other workspaces; overload or reverse engineer the Service (except as permitted by law); or resell the Service without consent.
8. Customer data and data export
8.1 The Customer retains all rights to data it enters ("Customer Data"). We use Customer Data only to provide the Service, as described in the Privacy Policy and the Data Processing Agreement (DPA), which forms part of these Terms. 8.2 The Customer can export its data during the subscription and for 30 days after termination. Until an in-app export is available, exports are provided in JSON or CSV format on request by email to info@genydev.nl. 8.3 After the 30-day export window we delete Customer Data within a further 30 days. Backups expire automatically within 35 days. Data we must keep by law (such as invoices) is retained only for that purpose.
9. Availability and support
9.1 We use reasonable (best) efforts to keep the Service available, but do not guarantee uninterrupted or error-free availability and offer no service level unless agreed in writing. Planned maintenance is announced where reasonably possible. 9.2 Support is provided by email at info@genydev.nl on a best-effort basis.
10. Intellectual property
All rights in the Service and software remain with Provider or its licensors. The Customer receives a non-exclusive, non-transferable right to use the Service for its internal business purposes during the subscription. Feedback may be used freely by Provider.
11. Liability
11.1 Our total liability arising from or relating to the agreement is limited to the amounts paid by the Customer for the Service in the 12 months preceding the event giving rise to the claim, with a maximum of EUR 10,000 (ten thousand euros) in total. 11.2 We are not liable for indirect or consequential loss, including lost profit, lost savings, loss of data, business interruption or reputational damage. 11.3 These limitations do not apply to damage caused by intent or gross negligence (opzet of bewuste roekeloosheid, i.e. wilful misconduct or deliberate recklessness) of our management, as required by Dutch law. 11.4 Claims lapse unless notified in writing within 12 months after the Customer became aware of the damage. 11.5 Force majeure (art. 6:75 Dutch Civil Code) includes failures of hosting, cloud or payment providers, internet outages and attacks beyond our reasonable control.
12. Confidentiality
Each party keeps the other's non-public information confidential and uses it only for the agreement.
13. Changes to these Terms
We may amend these Terms with at least 30 days' notice by email or in-app. If the Customer objects, it may cancel before the change takes effect.
14. Governing law and disputes
14.1 These Terms and the agreement are governed by Dutch law. The UN Convention on Contracts for the International Sale of Goods (CISG) is excluded. 14.2 Disputes are submitted exclusively to the competent court of the District Court of Zeeland-West-Brabant (Rechtbank Zeeland-West-Brabant), location Breda, the Netherlands, without prejudice to mandatory rules.
15. Miscellaneous
Invalid provisions are replaced by valid ones closest in intent. The Customer may not transfer the agreement without consent; Provider may transfer it to an affiliated or successor entity. English is the binding language.
